(the "provider") by consumers and businesses (the "customer").
A consumer within the meaning of these terms is any natural person entering into a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 BGB).
§ 2 Conclusion of contract
The presentation of products in the online shop does not constitute a legally binding offer but an invitation to order. By clicking the "Order with obligation to pay" button the customer submits a binding offer to purchase the items in their cart.
The provider confirms receipt of the order without undue delay by email. This confirmation does not yet constitute acceptance. The contract of sale is concluded by sending an order confirmation or by delivery of the goods.
§ 3 Prices and shipping costs
All prices are final and include statutory VAT. Shipping costs apply in addition per our shipping information. Shipping costs are shown separately during checkout before the order is placed.
§ 4 Delivery, lead times
We deliver within Germany and to the countries listed in our shipping information. Unless otherwise stated on the product page, goods are made to order after receipt of payment; production typically takes 2–4 working days. Transit time then follows: within Germany 2–4 working days, other destinations 4–10 working days. Partial deliveries are permitted where reasonable; no additional costs arise from this.
§ 5 Payment
The customer chooses from the payment methods offered during checkout. The invoiced amount falls due immediately upon completion of the order.
§ 6 Retention of title
The delivered goods remain the property of the provider until full payment is made.
§ 7 Right of withdrawal
Consumers have a statutory 14-day right of withdrawal for fixed catalogue layouts and standard sizes (including Community catalogue tracks) and accessories. Production after ordering or direct shipment by a printer does not itself remove this right. Only genuinely individual specifications, personalised designs or nonstandard custom dimensions may be exempt under § 312g(2) No. 1 BGB. We do not offer extra voluntary returns or exchanges. Defect and transport-damage rights remain unaffected. You bear direct return costs; for bulky tracks, actual return costs are estimated at no more than approximately €50 per track, including from all offered delivery countries; ordinary postal accessories incur direct return postage. Full details and the optional online form are in the withdrawal policy.
For paid digital content without a physical medium, early expiry only occurs on performance after prior express consent, acknowledgement of the loss of the right and confirmation under § 312f BGB (§ 356(6) No. 2 BGB). Payment alone does not end the right; statutory defect rights remain.
§ 8 Warranty
Statutory warranty rights apply. For consumers, the limitation period for warranty claims is two years from delivery of the goods.
§ 9 Liability
The provider is liable without limitation for intent and gross negligence and under the German Product Liability Act. For slight negligence the provider is liable for damages arising from injury to life, body or health, and for damages arising from breach of material contractual duties (cardinal duties). In that case liability is limited to foreseeable, contract-typical damage. Any further liability is excluded.
§ 10 Consumer arbitration
The provider is neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
§ 11 Applicable law, jurisdiction
The law of the Federal Republic of Germany applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. For consumers this choice of law applies only insofar as the protection afforded by mandatory consumer-protection provisions of the state of the consumer's habitual residence is not restricted.
